Move Yoga Ltd. Agreement of Release and Liability Waiver
I, the registrant, voluntarily participate in Group Exercise classes, workshops, events, or any related activities (collectively referred to as "Group Exercise") organized & conducted by Move Yoga Ltd. I understand that participation involves physical activity & has inherent risks, including the risk of injury or illness. By checking off this liability waiver, I acknowledge & agree to the following:
1. Membership & Participation:
a. By participating in any classes, workshops, or events at Move Yoga Ltd., I agree to abide by the policies set forth by the studio.
b. I am at least 18 years old or have the consent of a legal guardian.
2. Health & Safety:
a. I am in good physical health & free from any medical conditions that may be exacerbated by physical activity.
b. I am responsible for informing the studio of any pre-existing medical conditions, injuries, or limitations that may affect my ability to engage in physical exercise.
c. I will follow all instructor instructions to ensure safety during classes.
d. The studio reserves the right to deny participation to any individual who poses a risk to themselves or others.
3. Assumption of Risks: I understand that participating in Group Exercise involves certain risks, including but not limited to physical exertion, muscular & skeletal injuries, & the transmission of communicable diseases. I voluntarily assume all such risks & release Move Yoga Ltd., its instructors, employees, & affiliates from any liability arising from my participation in Group Exercise. I understand it is my responsibility to consult with a physician before & regarding my participation in group or private Group Exercise classes, workshops, & events offered by Move Yoga Ltd.
4. Personal Responsibility: I acknowledge that I am responsible for my participation & well-being during the Group Exercise. I will listen to my body, practice within my limits, & follow the instructions & guidelines provided by the instructor.
5. Waiver of Liability: I hereby release, discharge, & hold harmless Move Yoga Ltd., its owners, instructors, employees, & affiliates from any & all claims, demands, actions, or liabilities arising out of or related to my participation in Group Exercise, including but not limited to injuries, illness, property damage, or loss. I hereby release Move Yoga Ltd. from any & all liability related to any loss, theft, or damage of any of my personal property from the Move Yoga Ltd. premises.
6. Photography and Media Release: I consent to the use of any photographs, videos, or other media captured during Group Exercise for promotional purposes by Move Yoga Ltd. without compensation or further notice.
7. Governing Law and Jurisdiction: This liability waiver shall be governed by & construed by federal and provincial laws. Any legal actions or proceedings arising out of or related to this waiver shall be filed in the courts of Nova Scotia. I have carefully read & understand this liability waiver, & I voluntarily agree to its terms. I agree that this Agreement of Release & Waiver shall be governed by the laws of Nova Scotia and if any conflict arises between myself and Move Yoga Ltd., I will attempt to resolve the conflict in good faith through mediation before submitting my dispute to binding arbitration.
I hereby affirm that I am in good health & have no physical conditions or limitations that would prevent my safe participation in Group Exercise. I will promptly inform the instructor of any health conditions, injuries, or concerns that may affect my ability to participate.

Covid-19
1. I represent and warrant that I am physically fit and I have no medical condition(s) that would prevent my full participation in Group Exercise classes, workshops, and/or events offered by Move Yoga Ltd. and that I have not, within the past 14-days, experienced any symptoms that could be associated with Coronavirus (COVID-19) or, to my knowledge, been close to anyone who was either known or suspected to have had symptoms that could be associated with COVID-19 during the same time period.
2. I will update Move Yoga Ltd. as to any changes in my medical condition or contact with others with known or suspected exposure to COVID-19.
3. I will not enter the Move Yoga Ltd. premises or participate in any Group Exercise classes, workshops, and/or events offered by Move Yoga Ltd., if I experience symptoms, or, to my knowledge, have come in contact with anyone who was either known, or suspected to have had symptoms within the past 14-days, associated with COVID-19 or any other sign of illness, including, without limitation, fever, chills, cough, shortness of breath, or sore throat, or if I have a suspected, or diagnosed or confirmed case of COVID-19.
4. I will take all appropriate actions required by Move Yoga Ltd., including but not limited to, (i) know that Move Yoga Ltd. recommends, but is not required to wear a mask at all times while on the Move Yoga Ltd. premises or when participating in any yoga classes, workshops, and retreats offered by Move Yoga Ltd. unless otherwise instructed; (ii) adhering to all personal hygiene guidelines and social distancing guidelines prescribed by Move Yoga Ltd. and applicable public health guidelines, including staying at least six (6) feet away from all employees or participants.
5. If I have a body temperature above normal or any symptom that could be associated with COVID-19, I acknowledge that I will be asked to leave and not return until I have been COVID-19 symptom-free for at least 14 days. My signature and acceptance of this Agreement of Release and Waiver constitute my consent to Move Yoga Ltd.'s personal hygiene and social distancing policies prescribed here by Move Yoga Ltd., which may be revised from time to time.
6. In consideration for being permitted to participate in group or private yoga classes, workshops and retreats provided by Move Yoga Ltd., I agree to assume full responsibility and, on behalf of myself and, to the extent permitted law, my spouse, heirs, executors, administrators, assigns, and other persons or entities acting or purporting to act on my behalf, hereby generally and completely release, acquit, and forever discharge and release Move Yoga Ltd., its owners, officers, directors, employees, instructors, and representatives (the Move Yoga Ltd. parties) from any and all liability for any risks, illnesses, injuries or damages, known or unknown, which I might incur as a result of my participation, which shall include, but not be limited to, being exposed to, or contracting COVID-19. In further consideration thereof, I knowingly, voluntarily, and expressly waive any claim I may have against the Move Yoga Ltd. parties for any illnesses, injury, or damages that I may sustain as a result of my participation.
I have carefully read and understand this liability waiver, and I voluntarily agree to its terms. I agree that this Agreement of Release and Waiver shall be governed by the laws of Nova Scotia and if any conflict arises between myself and Move Yoga Ltd., I will attempt to resolve the conflict in good faith through mediation before submitting my dispute to binding arbitration.
